Presidential Powers (Temporary Measures) (Extension of State Liabilities Act to the Assets of Uzumba Maramba Pfungwe Zvataida Rural District Council) Regulations, 2025
The President has released Uzumba Maramba Pfungwe Zvataida RDC's attached tractors, lorries and equipment from execution under a High Court order, applying the State Liabilities Act to the council for the life of the regulations.
Made under section 2 of the Presidential Powers (Temporary Measures) Act, these regulations respond to a High Court order of 9 September 2025 registering an arbitral award for execution against the movable assets of Uzumba Maramba Pfungwe Zvataida Rural District Council.
The preamble records what was attached: two Massey Ferguson tractors, a New Holland tractor, two tractor trailers, a Kipor generator, an Isuzu Frontier, a Nissan Diesel lorry, Nissan hard body vehicles, an Isuzu Fleeter, a dump trailer, desktop computers and printers, a 5kV solar system and office furniture — equipment the council says it needs to collect refuse and maintain roads. It states that over 150 000 residents would be at risk of dysentery, typhoid and cholera if service delivery stopped.
The operative effect is that the State Liabilities Act [Chapter 22:13] applies, with necessary changes, to legal proceedings against the council — including proceedings commenced or completed before the regulations began. That Act shields property from ordinary execution and routes judgment creditors through its own procedure.
For the avoidance of doubt, all council assets attached or threatened with attachment under High Court order HC.3032/25 are released from attachment and revert to the council for the duration of the regulations.
Being Presidential Powers regulations, they are temporary: that Act's regulations lapse after six months unless replaced by an Act of Parliament. A creditor holding the award keeps the award but loses the execution route while they stand.
